Terms of Service

Please read these Terms of Service ("Terms") carefully before using NextPitch AI ("NextPitch," "we," "us," or "our") at nextpitchai.com (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Account Registration
You must create an account to use the Service. You agree to provide accurate, current, and complete information during registration and to keep your account credentials secure. You are solely responsible for all activity that occurs under your account. Notify us immediately at support@nextpitchai.com if you suspect unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.
3. Description of Service
NextPitch provides an AI-powered pitch practice platform that allows users to upload presentation materials, record spoken pitches, receive AI-generated transcriptions, and obtain automated feedback and scores across multiple performance dimensions. The Service is intended for educational and self-improvement purposes, including use by founders, students, employees, and competition participants.
4. Subscription Plans and Billing
4.1 Free Plan
A free tier is available with limited monthly sessions and recording time, as described on our pricing page. No payment method is required.
4.2 Pro Plan and Free Trial
The Pro plan is available via a paid subscription. Eligible new users may receive a 14-day free trial. A valid payment method is required to start the trial. Your payment method will not be charged until the trial period ends. If you do not cancel before the trial ends, you will be automatically charged the applicable subscription fee.
4.3 One Trial Per User
The 14-day free trial is available once per user account. Users who have previously used a trial are not eligible for an additional trial upon resubscribing.
4.4 Payment Processing
All payments are processed by Lemon Squeezy, Inc., who serves as the Merchant of Record for all transactions. By subscribing, you agree to Lemon Squeezy's Terms of Service and Privacy Policy. We do not store your payment card information.
4.5 Billing Cycle
Subscriptions are billed monthly or annually depending on your selected plan. Subscription fees are charged in advance at the start of each billing period. Prices are displayed in USD and are subject to applicable taxes.
4.6 Price Changes
We reserve the right to change subscription pricing with at least 30 days' notice. Continued use of the Service after a price change takes effect constitutes acceptance of the new price.
5. Cancellation and Refunds
5.1 Cancellation
You may cancel your subscription at any time through your Account page. Cancellation takes effect at the end of your current billing period. You will retain access to Pro features until that date. We do not provide partial refunds for unused time within a billing period.
5.2 Trial Cancellation
If you cancel during the 14-day free trial, you will not be charged. Access to Pro features ends immediately upon trial cancellation.
5.3 Refunds
All subscription fees are non-refundable except where required by applicable law. If you believe you have been charged in error, contact us at support@nextpitchai.com within 14 days of the charge.
6. Audio Recording Consent
By using the recording feature of the Service, you expressly consent to recording your own voice. You represent and warrant that:
- You are recording only yourself or have obtained all necessary consents from any other individuals whose voices may be captured.
- You will not record any third party without their knowledge and consent.
- Your recordings do not contain confidential information subject to non-disclosure obligations unless you are authorized to process such information through the Service.
Audio recordings are transmitted to OpenAI's Whisper API for transcription and are not permanently stored by NextPitch. By using the recording feature, you also agree to OpenAI's usage policies as they apply to audio data processed through their API.
7. AI-Generated Content Disclaimer
The feedback, scores, questions, and coaching suggestions generated by NextPitch are produced by artificial intelligence and are provided for educational and self-improvement purposes only. They do not constitute:
- Professional business, investment, or financial advice
- Legal advice
- Guaranteed outcomes in any pitch, competition, or business context
AI-generated content may contain errors, inaccuracies, or biases. You should exercise independent judgment and not rely solely on AI-generated feedback for consequential decisions. NextPitch expressly disclaims all liability for decisions made based on AI-generated content.
8. Acceptable Use
You agree not to use the Service to:
- Upload content that infringes third-party intellectual property rights
- Record or upload content containing personal data of third parties without their consent
- Attempt to reverse-engineer, scrape, or extract data from the Service
- Circumvent usage limits or access controls (including using multiple accounts to obtain additional free trials)
- Transmit malware, viruses, or any code of a destructive nature
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation
- Impersonate any person or entity
We reserve the right to suspend or terminate your account immediately and without notice if we determine, in our sole discretion, that you have violated these restrictions.
9. Intellectual Property
9.1 Your Content
You retain all ownership rights in the content you upload or create using the Service, including your pitch presentations, recordings, and responses. By using the Service, you grant NextPitch a limited, non-exclusive, royalty-free license to process your content solely for the purpose of providing the Service to you.
9.2 Our Platform
NextPitch and its licensors own all rights, title, and interest in the Service, including all software, design, trademarks, and content created by us. Nothing in these Terms transfers any ownership rights to you. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written permission.
9.3 Feedback
If you provide us with suggestions or feedback about the Service, you grant us an irrevocable, perpetual, royalty-free license to use that feedback for any purpose without obligation to you.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY OR COMPLETENESS OF ANY AI-GENERATED CONTENT.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEXTPITCH AND ITS OPERATORS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) USD $100.
12. Indemnification
You agree to indemnify, defend, and hold harmless NextPitch and its operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property or privacy rights; or (d) any content you upload or transmit through the Service.
13. Service Availability and Modifications
We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. We shall not be liable to you or any third party for any such modification, suspension, or discontinuation. We will endeavor to provide reasonable advance notice of any material changes that affect paid subscribers.
14. Termination
We may terminate or suspend your access to the Service immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the Service ceases immediately. You may request deletion of your account and associated data by contacting support@nextpitchai.com. Provisions of these Terms that by their nature should survive termination shall survive, including Sections 7, 9, 10, 11, 12, and 15.
15. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of China (Taiwan), without regard to its conflict of law principles. Any dispute arising out of or in connection with these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute is not resolved within 30 days, it shall be submitted to the exclusive jurisdiction of the courts located in Taiwan, Republic of China.
16. Changes to Terms
We reserve the right to update these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date. For significant changes, we will provide at least 14 days' notice via email or in-app notification before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and NextPitch with respect to the Service and supersede all prior agreements, representations, and understandings. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
